Terms and Conditions

1. Agreement Overview:

This Credit Repair Agreement ("Agreement") is made between 90 Day Credit Experts ("Company," "We," "Us") and you ("Client," "You"). This Agreement outlines the terms and conditions under which we will provide credit consulting services to you.

2. Services:

You will be enrolled in our Three-Step SOS (SAVE OUR SCORES) credit consulting process. This process includes:

  • Analysis: Identifying potentially negative or inaccurate items on your credit reports.

  • Plan Development & Execution: Creating and implementing a personalized plan to address these items.

  • Dispute Resolution & Follow-Up: Managing disputes with credit bureaus and providing updates on results.

By signing this Agreement, you:

  • Authorize us to act as your agent and sign documents on your behalf, including the Federal Trade Commission's Identity Theft Report.

  • Grant us power of attorney to act on your behalf regarding the items mentioned in this Agreement, including disputing inaccurate information with credit bureaus.

  • Acknowledge that your credit report may be updated to include a security/fraud alert statement.

  • Agree not to duplicate, resell, or share any information or documentation related to our methods.

Upon receiving your signed Agreement and specific account instructions, we will send necessary documents to credit bureaus within three business days via USPS (1-3 day express) with tracking information.

3. Fees and Payment:

  • Contingent Payment: No payment is required until services are rendered in full and completed.

  • Credit Report Fees: We may charge your billing information for credit reports, not exceeding $32 per month.

  • Prepayment: You may prepay any amount without penalty.

  • Late Charge: Payments more than three days late may incur a $25.00 late fee. We may attempt to use other payment methods on file.

  • Default: Default occurs if fees are unpaid within 30 days, payments are reversed after services begin, or lender applications are not submitted. A $250 annual late fee will be assessed until paid in full, and further legal action may be taken.

  • Payment Methods: Payments can be made via check or electronic funds transfer. You authorize us to use information from your check for electronic transfer.

  • Joint and Several Liability: If multiple individuals are listed, each is jointly and severally liable.

  • Collection Fees: You authorize us to contact you regarding your account. Delinquent accounts may be placed with a collection agency, incurring up to a 50% collection fee, plus court costs and attorney fees.

  • Due Date Change Fee: Changing the payment due date will incur a fee, calculated based on the number of days extended and the payment amount. Advancing the due date is free.

  • Debt Reporting: We may report the contract as a debt owed or completed to third-party vendors.

  • Contract Sale: We reserve the right to sell the contract to a third-party debt settlement or collections agency.

4. Third-Party Reports:

You authorize us to use your personal information and contact credit reporting agencies on your behalf.

5. Service Warranty:

Our goal is a 150-point collective increase in your credit score across all three credit bureaus within 90 days of signing this agreement. All point increases within this timeframe count towards the warranty. If your credit score wasn't available at signing, the 90-day period begins when it becomes available.

If you fulfill your obligations and do not see a 150-point increase, we will repeat the dispute process up to three additional times at no additional charge. If the 150-point increase is not achieved after these attempts or within 90 days, you may void the Agreement and we will waive any remaining Service Fee.

We may void this Agreement if you fail to fulfill your obligations, which include providing accurate information, maintaining active credit monitoring, refraining from adding new negative items to your report, and paying service fees.

6. Confidentiality:

You agree not to disclose our internal processes or proprietary information without our written permission.

7. Billing Information:

You authorize us to charge the fees outlined in this Agreement to your provided billing information.

8. Term and Termination:

This Agreement remains in effect until we have performed the outlined services, and you have provided all necessary documents, updated credit report information, and paid the Service Fee in full.

9. State-Specific Provisions:

  • California, Delaware, Louisiana, Missouri, Nebraska, Puerto Rico, Texas, West Virginia: You may be required to sign a new contract after 180 days to continue services.

  • Michigan: You may cancel this Agreement without penalty after 90 days if services are not completed.

  • Ohio: You may be required to sign a new contract after 60 days to continue services.

  • South Carolina: You may be required to sign a new contract after five years to continue services.

10. Disclaimers and Limitations:

We are not a lender, broker, credit monitoring service, or loan modification company. We act as consultants and advisors. Our liability is limited to the amount you have actually paid us.

Cancellation Policy

You may cancel this contract, without any penalty or obligation, before midnight on the fifth working day after you sign it. If you cancel, any payment made by you under this contract must be returned within 10 days following receipt by the seller of your cancellation notice.

To cancel this contract, mail or deliver a signed and dated copy of this cancellation notice, or any other written notice, to 90 Day Credit Experts at 333 W 2230 N St. Suite 200, Provo, Utah 84604 not later than midnight on the fifth working day after you sign this agreement.

Alternatively, you can email info@90daycreditexperts.com (please put notice of cancellation in the subject line) and attach a fully executed copy of this notice. You can also contact us with any problems or concerns by emailing our secretary at info@90daycreditexperts.com. If notice of cancellation is not received within the prescribed time frame outlined above, the fees outlined will be final.

Refund Policy

 

We have a no refund policy. However, if a mistake is made and you are billed incorrectly you will be refunded.
